The appeal confirmed the legality of the actions of the Mykolayiv building control department, which fined entrepreneurs for repairing a supermarket

The Odesa Court of Appeal upheld a fine of 839.9 thousand hryvnias to the budget of Mykolaiv from enterprises that violated urban planning legislation during the reconstruction of the supermarket.

According to the case materials, in June 2021, after state architectural and construction control measures were taken, the construction customer, Real Estate LLC, and the contractor, DI KOR-BUD LLC, were fined for violating the legislation in the field of urban planning.

After disagreeing with this decision, «Real Estate» LLC and «DI COR-BUD» LLC appealed to the court. However, in August and September 2023, the appeals administrative court rejected their claims.

During the review of these cases, the appellate court paid special attention to the fact that the failure of urban planning entities to perform construction works taking into account the requirements of urban planning legislation of Ukraine creates additional risks for the safety of visitors and employees of the store due to the possible negative consequences of the destruction of the building.

In November 2021, it was reported that the operation of the «ATB» supermarket in the building at 76/1 Kosmonavtiv Street in Mykolaiv could lead to irreversible consequences: the 14-story building risks completely collapsing and affecting nearby buildings.
